Conditions of Use

When you purchase from The Bellwether, you need to be sure you understand what you are purchasing. What you choose to do with your purchase is up to you -- we hope you enjoy spinning, nalbinding, knitting, and all the fiber arts we love!

That said, here is a more thorough statement of sales terms and conditions.

All orders for goods accepted by The Bellwether ("the vendor") are accepted subject to the following conditions which shall form part of and govern the contract of sale.

Acceptance of goods shall be deemed to be acceptance of these conditions of sale. Any term sought to be imposed by a purchaser either in the document or otherwise that conflicts with or adds to these conditions is not accepted.

No agent or representative of the vendor has authority to vary these conditions unless accepted in writing by the owner.

1 - Customer obligation

By placing and order, and thereby indicating acceptance of these terms and conditions, the customer confirms that they are aged 18 years or over at the time of placing the order and that any details provided are their own.

2 - Payment and Price

The vendor reserves the right to vary the quoted price for the goods in accordance with market conditions from time to time. The purchaser's price is set at the price on the website at the time the order is submitted; old prices and future prices will not be applied to an order once it is submitted. Price lists do not constitute an offer.

3 - Availability of Goods

The vendor will do its best to comply with the date named for posting or delivery which date is given and intended as estimate only and is not to be the essence of the contract. If owing to non-availability of the goods or any other causes beyond the vendor's control, the vendor shall be unable to effect delivery hereunder it shall be at liberty to determine the contract or part thereof by giving notice to the purchaser.

4 - Design Variation

While the vendor makes every effort to ensure that goods supplied correspond in every respect with the sample, specification or description provided as the case may be, the vendor is not responsible for minor variations in specification, in color or other design features, and no such minor variation shall entitle the purchaser to rescind the contract or shall be the subject of any claim against the vendor by the purchaser.

5 - Claims

a) The purchaser is obliged to notify the vendor of any damaged items within 24 hours of delivery.

b) No liability for any claim for damage or in respect of goods differing in quality or description from the particulars given on the shipment notification shall be accepted unless the vendor is notified within 24 hours of receipt of delivery and confirmed in writing by the purchaser within seven days of delivery.

6 - Guarantee

a) If the purchaser is not completely satisfied with goods supplied for whatever reason, goods may be returned to us, for immediate replacement or refund, within 15 days. They must be returned as received; spindles must have tags, and fiber must be in their original bags, labels, and information sheets. Refund includes product price only; postage cannot be refunded.

b) The purchaser shall, unless otherwise stated in writing, be responsible for all expenses and incidental charges incurred (such as, but not limited to, return postage).

7 - Returned Goods

a) If the purchaser properly rejects any of the goods in accordance with the within seven working days in writing, the purchaser shall be responsible for the cost of returning the goods.

b) If the returned goods received by the vendor are not in a condition where they can be sold as new then the vendor reserves the right to charge a minimum 15% restocking fee. Whether goods are returned in a saleable condition is to be judged by the vendor. They must be returned as received; spindles must have tags, and fiber must be in their original bags, labels, and information sheets.

c) It is reasonable for the buyer to open the outer packaging and inspect the goods.

d) The order cancellation must be put in writing and must be forwarded to either ask-at-thebellwether-dot-biz or sent to returns at our address which can be found on the "Contact" page.

e) The returned items must be received by the vendor within 15 days of the customer's receipt of the items.

f) All refunds will be processed within 30 days from when we receive notification of cancellation of the order.

g) If goods are to be credited/refunded, the original shipment charge will not be.

8 - Consequential Loss

The extent of the vendor's liability to the purchaser for any default or breach whatsoever or howsoever arising shall in no case exceed the invoice value of the goods and the vendor shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or any customer of the purchaser and whether direct, indirect, consequential or however else arising.

In that The Bellwether has no control over the use or assembly of product(s) offered for sale in this store, no liability shall be assumed nor accepted for any injury or damage resulting from product use. If the buyer is not prepared to accept the liability associated with the use of the product(s), the buyer is advised to return the product(s) in new and unused condition.

9 - Workshops

The participant holds The Bellwether and teacher harmless of any mishap that should occur during the class. The Bellwether provides a quality environment for learning in a private residence. Best efforts are made to inform you of the material, level of expertise required, and any special expectations such as classes involving dye, water, or specific materials. Please do not sign up for a class if you are allergic to dye, plant dyes, or other spinning or weaving fibers as the studio is full of such materials.

Unless stated otherwise on the registration page, refunds for workshops are available up to 1 week before the date of the actual workshop; after that, half of the amount paid will be refunded. You may send a substitute student; please notify me before the workshop of the substitution.

10 - Law

If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or the enforceability of the remainder of the conditions. This contract is and shall deemed to have been made in the USA and shall in all respects be governed by USA Law. In respect of consumer sales only, statutory rights are unaffected by these terms and condition.
